Workplaces are not obligated to provide a shelter, but may choose to construct a smoking shelter provided it has no more than a roof and two walls, and is not somewhere that is accessed in the course of anyone’s employment. Smoking shelters constructed on hospital, or other health care facility property must be 9 metres away from any entrance or exit.
Smoking shelters are not permitted on bar or restaurant property.
