County receives Ontario Environmental Review Tribunal decision on West Quarry Lake ECA

On October 28, 2015, Oxford County received the Ontario Environmental Review Tribunal (ERT) decision on the West Quarry Lake Environmental Compliance Approval (ECA). Oxford County and OPAL (Oxford People Against the Landfill) Alliance had submitted an application for leave to appeal in this matter on August 31, 2015.


The ERT ruled that it does not have jurisdiction to hear this matter, a decision that eliminates the County and OPAL’s right to seek leave to appeal the West Quarry Lake ECA decision.


The County is disappointed in this ruling and remains concerned with the ECA approval and its potential environmental consequences. We intend to review the decision in detail with the County’s legal counsel, evaluate our options, and determine an appropriate course of action.


In support of this course of action, County Council passed the following resolution his evening in formally receiving correspondence of the ERT decision:

That the decision from the Environmental Review Tribunal, dated October 28, 2015, regarding the Application for Leave to Appeal – Amended Environmental Compliance Approval for sewage works to facilitate ongoing quarry operations issued under Section 20.3 of the Environmental Protection Act, be received and referred to staff and legal counsel.
